Terms of Service

Welcome to Fitbud AI. By downloading, installing, accessing or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not use the App.

These Terms constitute a legally binding agreement between you and Fitbud AI regarding your use of the App. You must be at least 18 years old or have obtained parental/guardian consent to use our App.

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you through the App or via the email associated with your account. Your continued use of the App after such notification constitutes your acceptance of the updated Terms.

It is your responsibility to review these Terms periodically to stay informed of updates. If you do not agree to the revised Terms, you must stop using the App.

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you. By using the App, you consent to the processing of your information as set forth in our Privacy Policy.

To use Fitbud AI, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

We reserve the right to terminate or suspend your account at any time for any reason, including if you violate these Terms.

Fitbud AI requires a subscription to use its features. While the App is free to download, access to its features requires a valid subscription. We offer monthly and yearly subscription options.

Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.

All purchases are final. We do not provide refunds for subscription fees unless required by law.

We offer a 3-day free trial for users who sign up for our yearly subscription plan. No free trial is available for monthly subscription plans.

You will be automatically charged the yearly subscription fee when your free trial period expires unless you cancel your subscription at least 24 hours before the end of the trial period.

You can only use one free trial per account. We reserve the right to determine eligibility for free trials and to modify or limit free trial offers at our discretion.

You may cancel your subscription at any time through your App Store or Google Play Store account settings. Cancellation will take effect at the end of your current billing period.

We do not provide refunds or credits for partially used subscription periods. If you cancel during your free trial period, you will not be charged.

In the event of cancellation or termination of your account, you will lose access to all Fitbud AI features at the end of your billing period.

You agree not to use the App in any way that:

• Violates any applicable law or regulation
• Infringes the rights of any third party
• Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable
• Involves sending unsolicited advertising or promotional content
• Attempts to interfere with or disrupt the App or servers or networks connected to the App
• Attempts to reverse engineer, decompile, or otherwise try to extract the source code of the App
• Introduces viruses, trojans, worms, logic bombs, or other harmful material

We reserve the right to terminate or suspend your access to the App for any violation of these conduct guidelines.

The App and its contents, features, and functionality are owned by Fitbud AI and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.

You acknowledge that any feedback, suggestions, ideas, or other information or materials you provide regarding the App may be used by us without any obligation to you.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED; OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

FITBUD AI IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE. YOU SHOULD CONSULT WITH A HEALTHCARE PROFESSIONAL BEFORE STARTING ANY DIET, EXERCISE, OR SUPPLEMENTATION PROGRAM.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FITBUD AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP.

OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID TO USE THE APP, IF ANYTHING. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN FITBUD AI AND YOU.

You agree to defend, indemnify, and hold harmless Fitbud AI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App and cancel your subscription through the App Store or Google Play Store.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Fitbud AI is established, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in that jurisdiction.
